Case Discontinuance
Congratulations to Partner Rachel Bloom and Of Counsel Joseph Randazzo on securing a discontinuance after filing a motion for summary judgment on behalf of a Board-certified Plastic Surgeon and his practice in a case venued in Queens County Supreme Court. Plaintiff alleged the surgeon negligently performed a blepharoplasty by removing too much eyelid skin or tissue intraoperatively, resulting in incomplete eyelid closure. Ms. Bloom represented the defendant surgeon at his deposition, at which time he described the manner in which he performed the cosmetic surgical procedure, which fully comported with the standard of care. With support of an expert in Plastic Surgery, the defendants moved for summary judgment, arguing the surgeon correctly performed the fully consented-to surgery in all respects. Further, none of the surgeon’s alleged acts or omissions are causally related to the plaintiff’s claimed injuries. After serving the motion, plaintiff decided to voluntarily discontinue the case in its entirety.
