Summary Judgment Dismissal

HPM&B recently obtained summary judgment dismissal on behalf of an Emergency Medicine Physician and an Emergency Medicine Practice. In this Queens County case, plaintiff alleged the defendants failed to diagnose a superior mesentery artery thrombosis/dissection.   HPM&B moved for summary judgment with the support of an Emergency Medicine Expert. The defendants successfully established that they created an appropriate treatment plan and fully comported with the standard of care when treating plaintiff in the Emergency Room. Specifically, a CT scan was performed which was reported to be unremarkable with no evidence of a bowel obstruction and plaintiff was appropriately discharged home after bloodwork was obtained and reviewed. Plaintiff’s attorneys did not submit opposition to the motion, and the case was dismissed against our clients in its entirety.
