Summary Judgment Dismissal

HPM&B recently obtained summary judgment dismissal on behalf of a podiatrist and his professional corporation in Suffolk County Supreme Court. Plaintiff alleged that the defendant podiatrist negligently administered a series of steroid injections to the plaintiff’s left foot, causing a ruptured tendon. The defense contended that it was plaintiff’s activities – and not the injections – which caused the ruptured tendon. The Court agreed and granted summary judgment dismissal of all claims alleged against the defendants, finding that that plaintiff and her expert failed to sufficiently address the defense’s expert opinions.
