Marshall provides thoughtful analysis of any legal issues that may arise throughout litigation, from pleadings to discovery to dispositive motions to trial to appeals. He has extensive experience drafting motions and appeals throughout the state of New York. Prior to joining the firm, Marshall worked in the Office of General Counsel of the Workers’ Compensation Board. He also previously worked as a Volunteer Assistant Attorney General in Rochester, representing the State in Article 78, Mental Hygiene Law, and Habeas Corpus petitions.

Kanaly v DeMartino, 162 AD3d 142 (3d Dept 2018) – Marshall successfully persuaded the Third Department to adopt the Second Department’s rule regarding disclosure of experts in medical malpractice actions. Parties are now required to disclose the names and full qualifications of all experts, unless there is a reasonable probability that the expert would be subject to intimidation or threats if their identity was revealed.

Marshall was a member of the Editorial Board of the St. John’s Law Review.

When not lawyering, Marshall enjoys building Lego sets with his two young sons.
