Defense Verdict

HPM&B recently obtained a unanimous defense verdict in New Haven Superior Court on October 29, 2024 after a three week jury trial.  Plaintiff was 39 years old when he underwent a foot surgery to alleviate his complaints of heel pain caused by plantar fasciitis, performed by the defendant podiatrist.  There were no complications noted intraoperatively, but post-operatively, plaintiff complained of numbness in his foot, the timing of which was a highly contested fact in the case.  Plaintiff claimed that the defendant improperly performed the subject surgery and that a nerve in his foot was injured during the procedure, which caused him foot pain, numbness, swelling, muscle atrophy, an altered gait, and generalized pain and suffering.  In closing, plaintiff’s counsel requested a damages award of between $1.2 to $2.8 million.   After almost seven hours of deliberations, the jury returned a unanimous verdict in favor of the defendant, finding that the procedure did not cause the plaintiff’s claimed injuries.
