Defense Verdict In Queens County
On October 26, 2010, Anthony M. Heller received a defense verdict in a podiatry/vascular medicine case in which plaintiff alleged that our client, a podiatrist failed to timely refer her to a co-defendant vascular surgeon, resulting in a below-the knee amputation.
Plaintiff, an insulin dependent diabetic, claimed that her leg would have been saved had she been referred earlier to vascular medicine and had she not been subjected to aggressive debridement. Plaintiff underwent both atherectomy and lower extremity bypass surgery.
We argued that the plaintiff had unreconstructable vascular disease resulting from long-term diabetes but that wound care rendered by our podiatric client was nevertheless appropriate and successful to a point in time.
The jury returned a verdict unanimously finding no departures on behalf of our client and awarding him a defense verdict.
