Defense Verdict Obtained In Connecticut Superior Court
Bruce F. Gilpatrick recently obtained a defense verdict in a wrongful death case brought by the estate of a 68-year-old business executive against a Board Certified Urologist in Stamford, Connecticut.
Plaintiff claimed that there was an approximate one year delay in the diagnosis and treatment of bladder cancer resulting in decedent’s death. After a bench trial, the Superior Court found in favor of HPM&B’s client based on the testimony by defense experts in the specialties of urology and oncology. These experts testified that further workup for hematuria was not necessary in light of negative cytologies and relief of symptoms following antibiotic therapy. They also testified that since the decedent suffered from a particularly lethal tumor it had metastasized before it was detectable, depriving the decedent of a real chance for a cure.
