Defense Verdict in New York County
Vincent Gallo won a defense verdict in favor of a plastic surgeon in New York County. The case involved allegations that the plaintiff had developed numerous contour irregularities following liposuction procedures to her thigh. More specifically, plaintiff argued that the defendant plastic surgeon negligently performed touch-up liposuction procedure resulting in further contour irregularities.
The initial liposuction procedures were performed by the co-defendant. Gallo established that the defendant’s surgical technique was appropriate, and that based upon postoperative photographs, that there was actually an improvement in the contour of the patient’s thigh following the reparative liposuction.
Further, plaintiff’s expert conceded on cross-examination that he could not state to a reasonable degree of medical certainty whether the defendant caused any injury to the plaintiff’s thigh. Following a two-week trial, the jury returned a unanimous verdict in favor of all defendants.
