HPM&B Partner Charles Bach obtained a unanimous defense verdict in a medical negligence case
HPM&B Partner Charles Bach obtained a unanimous defense verdict in a medical negligence case on behalf of a skilled hand surgeon who was named as a defendant by the plaintiffs. The case was tried in New York County Supreme Court. Mr. Bach was assisted by Of Counsel Jason Barrer during the course of this lengthy litigation. Following the defense verdict, plaintiffs’ counsel filed a motion to set aside the verdict and for a new trial on the basis that the jury’s verdict was contrary to the weight of the evidence. This motion was opposed and argued by Mr. Bach, and plaintiffs’ motion was denied in its entirety.
Plaintiff had a history of Dupuytren’s contracture and extensive osteoarthritis in her hand. The plaintiffs alleged that the defendant hand surgeon departed from the standard of care with respect to the claim of improper placement of silicone metacarpophalangeal joint implants resulting in the need for three additional surgeries by a subsequent treating hand surgeon. After considering all of the evidence before it, the jury unanimously rendered a defense verdict!
