Michael Sullivan Receives Another Defense Verdict in Kings County
Michael Sullivan obtained a defense verdict in a Supreme Court, Kings County podiatric malpractice case on October 22, 2018.
Plaintiff underwent multiple surgeries by the defendant podiatrist for treatment of recurrent hammertoes. She claimed that the defendant removed too much bone from her toes and failed to use K-wires during the surgeries. Plaintiff claimed that this negligence resulted in excessively shortened and floppy toes. Mr. Sullivan established through the testimony of his client and the testimony of a defense expert that plaintiff’s surgeries were properly performed and any deformities in her toes after those surgeries were a known and fully disclosed risk of multiple hammertoe procedures.
After six days of testimony before the Honorable Karen Rothenberg, the jury rendered a defense verdict after one hour of deliberations.
