Summary Judgement Dismissal in Federal Court

HPM&B Partner Doreen Dufficy and Senior Associate Gabrielle Apfel recently secured a summary judgment dismissal. Summary Judgment was granted in United States District Court, Eastern District of New York in a case where plaintiff alleged that our client, a Physician’s Assistant, was deliberately indifferent to his serious medical needs under 42 U.S.C. §1983 with respect to the diagnosis and treatment of a bicep tendon rupture. With the support of our Internal and Emergency Medicine Expert, it was established that there were no deviations from the standard of care or deliberate indifference to serious medical needs, and referral to a specialist was appropriate.
